1. Introduction
These Terms of Service (the "Terms") are a legally binding agreement between you and DEICIDE concerning your access to and use of https://deicide.net and any related websites, online stores, user accounts, community features, digital services, APIs, applications, and future products or services made available by DEICIDE, including future DEICIDE-operated game services and any related game systems, virtual items, or interactive experiences (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms and by any additional policies, guidelines, community standards, purchase terms, rules, or notices that we may publish for specific parts of the Services. If you do not agree to these Terms, you must not access or use the Services.
2. Eligibility
You may use the Services only if you have the legal capacity to enter into a binding agreement with DEICIDE and are not prohibited from using the Services under applicable law.
If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian. Certain Services, including certain game, commerce, or community features, may be subject to additional age restrictions.
You represent and warrant that any information you provide to DEICIDE is accurate, current, and complete, and that your use of the Services will comply with all applicable laws, regulations, and community rules.
3. Accounts and Authentication
Some portions of the Services require an account. You are responsible for maintaining the confidentiality of your login credentials, authentication methods, account devices, and any linked third-party account connections.
You are responsible for all activity that occurs through your account, whether or not authorized by you, unless otherwise required by law. You must notify us promptly if you believe your account has been accessed without authorization or otherwise compromised.
DEICIDE may use third-party authentication and infrastructure providers, including providers such as Clerk, to support account creation, sign-in, security, and account management. Your use of those authentication pathways may also be subject to the terms or privacy practices of those providers.
- You may not share, sell, transfer, lease, or sublicense your account unless DEICIDE expressly authorizes it in writing.
- You may not create accounts using false identities, deceptive credentials, or credentials that infringe the rights of others.
- We may suspend, restrict, or terminate accounts that violate these Terms, create security or legal risk, or otherwise interfere with the integrity of the Services.
4. Acceptable Use
You may use the Services only for lawful purposes and only in a manner consistent with these Terms, any posted rules, and any applicable community guidelines. You may not misuse the Services, attempt to bypass restrictions, or interfere with other users' access or enjoyment.
- Use the Services in violation of any law, regulation, export control, sanctions program, or third-party right.
- Harass, threaten, abuse, defame, stalk, exploit, or otherwise harm any person or group.
- Upload, distribute, or transmit malware, malicious code, cheats, bots, scripts, exploits, or unauthorized automation.
- Attempt to reverse engineer, scrape, probe, scan, bypass, disable, or interfere with security, rate limits, access controls, moderation systems, anti-cheat tools, or technical protections.
- Use the Services to cheat, exploit bugs, manipulate game outcomes, abuse game economies, farm items, or otherwise gain an unfair advantage in any DEICIDE-operated game service.
- Impersonate DEICIDE, another user, a public figure, or any other person or entity.
- Use the Services to infringe intellectual property, privacy, publicity, or other proprietary rights.
- Collect or harvest information from other users without authorization.
- Engage in fraud, chargeback abuse, payment abuse, resale abuse, or market manipulation involving digital items, virtual goods, or merchandise.
5. User Generated Content
Certain Services may allow you to submit, upload, publish, transmit, display, stream, or otherwise make available content, including usernames, profile content, text, images, audio, video, chat messages, support messages, feedback, social posts, or other materials (collectively, "User Content").
You retain ownership of User Content that you own, but you grant DEICIDE a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, publish, display, perform, distribute, and otherwise use that User Content as reasonably necessary to operate, improve, promote, moderate, secure, and provide the Services.
You represent and warrant that you have all rights necessary to submit the User Content and to grant the license above, and that your User Content does not violate law or infringe the rights of any person or entity.
DEICIDE is not obligated to pre-screen User Content, but we may review, remove, restrict, or moderate User Content at any time in our discretion, including to enforce these Terms, our community rules, applicable law, or to protect users, DEICIDE, or third parties.
6. Digital Content and Game Services
DEICIDE may make available digital content, access rights, downloadable materials, account-linked game features, online gameplay, progression systems, community systems, and future DEICIDE-operated game features. These Services may evolve, reset, change, or be discontinued at any time.
Game-related services may depend on online functionality, server uptime, anti-cheat systems, moderation tools, platform integrations, account standing, payment status, geographic availability, hardware compatibility, or other technical and business factors. We do not guarantee that any game service, feature, character progression, leaderboard, item inventory, or online system will always be available or operate without interruption.
DEICIDE may monitor gameplay and related activity for security, service integrity, enforcement of rules, and anti-cheat purposes. We may investigate suspected cheating, exploitation, fraud, automation, or abuse, and may take enforcement action including warnings, resets, item removal, matchmaking restrictions, account suspension, permanent bans, or legal action where appropriate.
7. Purchases and Payments
The Services may include physical merchandise, subscriptions, memberships, digital content, preorders, and other paid offerings. Prices, availability, release timing, product descriptions, shipping details, and promotional terms may change at any time.
By placing an order, you authorize DEICIDE and its third-party payment processors to charge the payment method you provide for the applicable amounts, taxes, shipping, recurring charges, or other disclosed fees. Payments may be processed by third-party processors such as Stripe or similar providers.
DEICIDE reserves the right to refuse, limit, cancel, or refund orders where necessary to address inventory constraints, pricing errors, fraud concerns, export restrictions, payment issues, suspected abuse, or violations of these Terms.
- Physical merchandise orders may be subject to shipping restrictions, fulfillment delays, customs obligations, loss in transit, preorder timing, or other operational constraints.
- Subscriptions may automatically renew unless canceled in accordance with the applicable subscription terms or billing interface, where offered.
- You are responsible for providing accurate billing, shipping, tax, and contact information for all purchases.
8. Virtual Goods
DEICIDE may offer or permit access to virtual goods, virtual items, virtual currency, cosmetic items, consumables, game access rights, unlocks, progression benefits, or similar digital entitlements for use within future Services (collectively, "Virtual Goods").
Virtual Goods are licensed, not sold. Virtual Goods have no cash value, no real-world value, are not personal property, and are not redeemable, transferable, or exchangeable for money or monetary value except where required by applicable law.
DEICIDE may manage, modify, remove, rebalance, replace, reset, discontinue, or revoke Virtual Goods, game economies, access rights, or related systems at any time, with or without notice, including as part of balancing, anti-fraud, anti-cheat, security, operational, or product decisions.
Unless otherwise required by law, you have no ownership interest in Virtual Goods, game progress, or account-linked digital entitlements, and DEICIDE is not obligated to provide refunds or compensation for changes, removals, resets, suspensions, or discontinuation affecting those items or systems.
9. Intellectual Property
The Services, including all software, code, designs, names, logos, artwork, audiovisual content, text, graphics, user interface elements, game assets, worldbuilding, characters, virtual items, trademarks, trade dress, and other DEICIDE materials are owned by DEICIDE or its licensors and are protected by intellectual property and other laws.
Except for the limited right to use the Services in accordance with these Terms, no license or other rights are granted to you by implication, estoppel, or otherwise. You may not reproduce, modify, distribute, sell, sublicense, publicly display, publicly perform, or exploit any part of the Services except as expressly authorized by DEICIDE.
10. Termination of Accounts
You may stop using the Services at any time. DEICIDE may suspend, limit, disable, or terminate your access to some or all of the Services, with or without notice, if we reasonably believe that you have violated these Terms, created legal or security risk, harmed other users, engaged in cheating or fraud, or otherwise used the Services in a way that is inconsistent with DEICIDE's interests or the integrity of the platform.
We may also suspend or discontinue the Services, or any part of them, for operational, legal, business, technical, or security reasons. Upon suspension or termination, your right to use the affected Services will cease immediately. Sections of these Terms that by their nature should survive termination will survive, including provisions regarding ownership, licenses, disclaimers, limitations of liability, indemnification, dispute-related terms, and enforcement rights.
11. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. DEICIDE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
Without limiting the foregoing, DEICIDE does not guarantee that merchandise, digital content, online features, virtual goods, progression, account data, or community features will always be available, preserved, or suitable for your specific needs.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEICIDE AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTRACTORS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS, DIGITAL ITEMS, VIRTUAL GOODS, ACCOUNT ACCESS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF DEICIDE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO DEICIDE FOR THE RELEVANT SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you to the extent prohibited by law.
13. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless DEICIDE and its affiliates, licensors, contractors, service providers, and personnel from and against any claims, demands, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your User Content, your violation of these Terms, your violation of law, or your infringement or misappropriation of any rights of another person or entity.
14. Third-Party Services
The Services may integrate with or link to third-party products, websites, platforms, infrastructure, marketplaces, payment providers, community tools, communication platforms, analytics services, hosting providers, or APIs, including services such as Discord, Clerk, Supabase, Vercel, Stripe, and similar providers.
DEICIDE does not control third-party services and is not responsible for their content, functionality, policies, availability, or terms. Your use of third-party services may be subject to separate agreements or privacy policies between you and those third parties.
15. Modifications to Services
DEICIDE may modify, suspend, remove, replace, or discontinue any part of the Services at any time, including features, products, content, game systems, virtual goods, storefront offerings, APIs, integrations, availability, or supported platforms.
We are not obligated to continue offering any specific Service, feature, product line, digital item, online mode, community space, or game system, and we may impose limits on access, availability, or usage at any time.
16. Changes to Terms
We may update these Terms from time to time. If we do, we will post the revised Terms and update the "Last Updated" date at the top of the page. Changes will become effective when posted unless otherwise stated.
Your continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the affected Services.
17. Governing Law
These Terms and any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be governed by the laws of the State of New York and applicable federal laws of the United States, without regard to conflict of law principles, except to the extent otherwise required by applicable law.
You agree that, unless otherwise required by law, any legal action arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts.
